Right to Manage

Simply put… leaseholders now have the

right to manage

their own building.

After meeting certain criteria points, you and your fellow leaseholders can, via a series of served notices, acquire the

right to manage

your building or development. You can either manage it yourselves or employ Cable Rock to take care of it for you. Of course you must adhere to the terms of your lease at all times.

According to the Leasehold Advisory Service:

‘The Commonhold and Leasehold Reform Act 2002 provides a right for leaseholders to force the transfer of the landlord’s management functions to a special company set up by them – the

right to manage

company. The right was introduced, not just as a means of wresting control from bad landlords, but also to empower leaseholders, who generally hold the majority of value in the property, to take responsibility for the management of their block.’

Acquiring the

right to manage

can be quite a task. What with, confirming your development’s eligibility, selecting the right legal advisor, educating and then gaining the commitment from other leaseholders and managing the process can be quite a time consuming and daunting task.

It is for this reason that Cable Rock’s

RTM

Project Management service has been so popular.

We’ll do all the ‘leg work’, advice on eligibility, conduct the meetings, organise the set up of the

right to manage

Company, liaise with residents, legal advisors and accountants, and potentially it will only cost you legal fees and disbursements depending on what your ongoing management arrangements are.
